Shia LaBeouf isn’t facing DUI charges after his car accident back in July.
The Los Angeles County District Attorney’s spokeswoman, Jane Robison, tells People that “after reviewing the case, we’ve declined to file any charges due to insufficient evidence.”
Instead they plan on filing criminal charges against the other driver, Simon Herbert, who was driving and broke a red light.
Because the 22-year-old actor refused to take a blood test he will have his license “automatically suspended for six to nine months.”

Shia LaBeouf and the rest of the cast for his new movie attend the world premiere for Eagle Eye at the Mann’s Chinese Theatre on Tuesday (September 16) in Los Angeles, CA.
The movie is about two strangers (LaBeouf and Michelle Monaghan) become the pawns of a mysterious woman they have never met, but who seems to know their every move. Realizing they are being used to further her diabolical plot, they must work together to outwit the woman before she has them killed.
Shia recently said he is shocked at how much info the CIA have on people, he said while preparing for the movie the CIA let him hear some conversations he had on the phone.
He said “it is reality, the scary thing is sitting down with CIA operatives, who use this stuff. They played me back phone conversations I’ve had. It was extremely embarrassing.”
Rosario Dawson, Anthony Azizi and Billy Bob Thornton also star.
